 F.48-2/2010/NCTE/N&S/A12784 dated 30^th March 2010 regarding clarification w.r.t. applications submitted online.

As per the decision of ERC in its 105^th meeting, letter was sent to NCTE-HQrs seeking specific directions, guidelines as to how to deal with the cases where the Deficiency letters sent to the institutions have returned undelivered, specially when the DLIs have been generated online through MIS Software.

The NCTE-HQrs vide its letter dated 30^th March 2010 had issued the guidelines for dealing with such cases.

Accordingly, as per the directions of NCTE-HQrs, the office had sent an E-mail to all the 46 institutions enclosing the copy of DLI and also the copy of DLIs have been displayed on the public domain of ERC for information.

A fax dated 6^th April 2010 has been received from Chairperson, NCTE-HQrs regarding procedure to be followed for dealing with the complaints received against the institutions.

A letter dated 31^st March 2010 has been received from NCTE-HQrs wherein the NCTE-HQrs has directed that Inspection u/s 17 of the NCTE Act be conducted for the following institutions :-

The Committee noted the decision of Appeal Committee vide order No. 89-1093/2009-Appeal/A11788 dated 05.03.2010 has been reversed to ERC for necessary action and considered  along with relevant documents, NCTE Act, Regulations 2007 and guidelines of NCTE published from time to time and decided that seek further clarification from the institution for the following reasons.

(i)                  It has been observed that the Principal was appointed, after the implementation of the new norms where Ph.D. in Education is required, whereas the Principal, newly appointed is Ph.D. in  Sociology.

Sub : CWJC No.4650 of 2010 filed by Rajendra Kumar Vs. – The NCTE and Anr. In the Hon’ble High Court.

            Sh. S.N. Pathak, vide his letter dt.02.04.2010 received on 08.04.2010 has forwarded a copy of the order / judgment dt.29.03.2010 passed by the Hon’ble High Court on the subject mentioned above. The Hon’ble High Court has been pleased to dispose of the matter with the observation as follows:

            If as the petitioner claims, he has removed the deficiencies pointed out during inspection, the respondents are now expected to take final decision on the aspect of recognition in accordance with law within a maximum period of ten weeks from the date of receipt and / or production of a copy of this order.

            If the respondents propose to pass an order adverse to the petitioner, they shall be required to furnish the grounds to the petitioner with opportunity to meet the same and thereafter pass a reasoned and speaking order, all within the same period of time.

 Surendra B.Ed. Teachers Training College, Surendra nagar, Shiwala More, Khagul, Patna, Bihar – 800001 (B.Ed.), (Private) Code No. APE00521Reply in response to deficiency letter issued in cases of applications received as per 2009 Regulations.

 The Committee considered the case of the institution and observed that in obedience of Honorable High Court’s Order, the institution was given two opportunities  to appear before ERC meeting held on 9^th – 11^th March 2010 and 20^th - 22^nd April 2010. However as the representative fail to present on these dates despite after appropriate communications, a final opportunity is given for the purpose on 6^th May, 2010. In case of further default on this day the ERC will pass final order immediately thereafter keeping in view of Honorable  Court’s directions. The NCTE advocate may be informed accordingly.
