An emergent meeting of the Eastern Regional Committee was held on 25th of May 2010 at 10.00 a.m. in the Conference Room of ERC, NCTE, Bhubaneswar in the light of the directions of the Hon’ble High Court of Patna in CWJC No.13927 of 2009 of Vijay Kumar V/s The State of Bihar & Others and the subsequent DO letter of NCTE No.14-11/2009/NCTE/Insp./Bih.A16151 dated 18th May 2010 addressed to the Regional Director from the Member Secretary, NCTE, New Delhi.
In conformity with the directions conveyed in Member Secretary’s letter referred to above following the decision of the Hon’ble High Court, the ERC decided that:
1. Show Cause Notice to be issued to the institutions under Section 17 for withdrawal of recognition to the twenty one institutions figuring in the list as per Para-2 of the DO letter from Member Secretary, NCTE as mentioned above providing twenty one days time for offering explanation from the date of issue of the notice as per the observations of the Expert Committee in its report submitted to the Hon’ble High Court.
2. Notice under Section-17 to be issued to institutions in respect of which the committee of experts has pointed out faculty related and other deficiencies giving six months time to make up the deficiencies to confirm to the norms of NCTE as special case failing which final decision will be taken as per the Provisions of the NCTE Act, Rules & Regulations and observations of the Expert Committee in its report submitted to the Hon’ble High Court with no further notice.
It has also been decided that the ERC-NCTE meeting scheduled from 8th to 11th June, 2010 to be rescheduled from 21st to 25th June, 2010.
