The Committee deliberated and considered the case in detail. The Committee reviewed its earlier decision taken in 117th meeting and decides that before taking final decision following documents/clarifications are required to be submitted by the institution :-

1. The hard copy of the application of the institution has not been dispatched within the time limit of seven days of the submission of online application. Therefore, the institution is required to submit a proof of dispatch of application so as to verify that the application of the institution was dispatched within 7 days after on line submission of the application.

2. The institution has not submitted registered land documents in the name society/trust/institution which is an essential requirement as per Regulations 2009.

The institution shall submit the above details/ clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.

In view the NCTE Hqr. letter No.F.48-2/2011/NCTE/N & S (PT) A37157 dated 1st June, 2011, the ERC decides that a show cause notice be issued under clause 7(1) of NCTE Regulations, 2009 as to why their application be not summarily rejected giving the institution 21 days time

1. The institution be asked to explain that “the application ID is mentioned in the print out of online application submitted by the institution at ERC, whereas in the soft copy of the application form available online in NCTE website, the application is not mentioned.

The institution shall submit the above details/ clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.

In view the NCTE Hqr. letter No.F.48-2/2011/NCTE/N & S (PT) A37157 dated 1st June, 2011, the ERC decides that a show cause notice be issued under clause 7(1) of NCTE Regulations, 2009 as to why their application be not summarily rejected giving the institution 21 days time.

The Committee deliberated and considered the case in detail. The Committee reviewed its earlier decision taken in 117th meeting and decides that before taking final decision following documents/clarifications are required to be submitted by the institution :-

1. The university be asked to refer to clause 8 (3) of NCTE regulations 2009 “an institution can apply for one basic unit only of an additional course or for an additional unit of the existing recognized course after completion of three academic sessions of the respective course..” and give its option for processing of one application.

2. As per para 8 (4) of NCTE Regulations 2009 for additional course or for an additional intake NAAC certificate with at least a letter Grade B developed by NAAC is required.

3. The hard copy of the application had not been dispatched within the time limit of seven days of the submission of online application for M.Ed (Regular) and M.Ed (Distance Mode).

The University shall submit the above details/ clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.

1. The land document is not in the name of the institution / society / trust which is not as per the NCTE Regulations.

2. The institution has not submitted any supporting documents to reveal that a separate land is earmarked in the name of institution alongwith the building structure.

3. A certificate from D.E.O./Affiliating University that no other institution is functioning at present in the proposed “Ram Shrestha Singh Teacher Training College”

4. No psychology lab developed, only few psychology test displayed in the corner classroom table which is not acceptable as per NCTE norms.

5. Library is not meant for B.Ed course as per the CD submitted by the institution to the VT.

6. None of the laboratories are developed for B.Ed course as per NCTE norms.

7. PAN Card submitted by the institution is in the name of Ram Shreshtha Singh College Institution and not in the name of the institution applied for the course.

8. ICT Laboratory not developed at all as per CD submitted by the institution to the VT.

9. The institution has submitted No Objection Certificate from the University authority. As per NCTE norms only State Govt is competent to issue NOC for starting B.Ed course.

The institution shall submit the above details/ clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.

Hence the ERC decides to seek above details/clarification under section 14(3) (b) of the NCTE Act on the above points and direct the institution to submit the reply as per provisions of the NCTE Act, Rules & Regulations within 21 days.

1. The building plan submitted by the institution on Plot No. 170, 172 & 173 is different from the land use certificate submitted by the institution for Plot No. 170, 179, 180 & 182 except Plot No. 170. The institution may clarify.

2. The institution is required to submit a building completion certificate issued by the approved Engineer/Architect certified by the competent govt./local body authority (copy of the format is enclosed).

3. The size of Multipurpose hall is not as per NCTE norms.

4. No of titles in the library books are less than the required as per NCTE norms.

5. Library is not computerized.

6. Health and Physical Resource Centre not developed at all.

7. Science equipments are displayed on removable table and no permanent fixture and water drainage facility provided.

8. Computers are not sufficient for one unit of B.Ed students

3. The institution be directed to submit the recent building plan showing the size of Classroom and Multipurpose hall.

4. Psychology resource centre not developed at all

5. A fresh CD depicting classroom, multipurpose hall, library and all laboratories except ICT as per the NCTE norms as the CD submitted to VT could not display the above said matter.

6. Total no of library books are less as per NCTE norms.

The institution shall submit the above details/ clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.

4. None of the laboratory, resource centres required for the B.Ed course are developed as per the NCTE norms.

5. Building of the institution is very old. Hence, the institution is asked to submit electricity and telephone bills paid by the institution for the last three months.

The Committee noted that the institution has not satisfactorily complied with the deficiencies communicated to the institution vide Show Cause Notice dated 19.5.2011. The Committee also noted that the institution failed to comply with the provisions of clause 7(5) of the NCTE regulation 2009 which clearly provides that “At the time of the visit of the team of experts to an institution, the institution concerned shall arrange for the inspection to be video graphed in a manner that all important infrastructural and instructional facilities are video graphed alongwith interaction with the management and the faculty”. Therefore, the following deficiencies exists as per the provisions of the NCTE Regulations, 2009.

1. Three storied library is under construction within the premises. Some portion of the room shown in CD as the library, racks with few books are available, which is not appropriate library for teacher training course. There is no internet facility in the library. No seating space in the library available as per NCTE norms.

2. Principal’s office is not appropriate for teachers training institution.

3. Basic Science Lab as seen in CD appears like a medical/pharmacy lab.

4. Multipurpose hall is not shown in the CD submitted by the institution to the VT members at the time of inspection.

5. Arts and Crafts Resource Centre, Health and Physical Education Resource Centre, and Science & Mathematics Resource Centre not developed at all.

6. Multipurpose play field not developed at all.

7. Teaching learning materials for Language Lab not developed.

Hence the ERC decides to refuse grant of recognition to the institution under section 14(3) (b) of the NCTE Act on the above points.

2. At the time of inspection the building of the institution was under construction, which is not acceptable as per clause 7 (10) of NCTE Regulations 2009.

3. The existing laboratories are still without furniture

4. Payment of salary by cash is violation of clause 10 (2) of NCTE Regulations 2009.

5. Vouchers submitted by the institution for psychology and language lab material are not acceptable as they do not show the details of equipments and also the same not verified by the institution.

6. Site plan submitted by the institution is not approved by the competent government authority.

7. No documents submitted by the institution about the procedure followed for appointment of teaching and non-teaching staff.

8. The institution has submitted only the list of furniture without support of proper & authentic bills.

9. List of faculty submitted by the institution is not countersigned by the competent authority of the affiliating University.

10. The few photographs submitted by the institution for science lab is not satisfactory and not acceptable as per NCTE norms.

In view of the above and as per the V.T. Report the Committee come to the conclusion that the institution has violated the provisions of the NCTE Act, Rules & Regulations as it was running without teachers and inadequate infrastructural and instructional facilities.

Hence the ERC decides to withdraw recognition to the institution under section 17 (1) of the NCTE Act on the above points.

The Committee deliberated and considered the case in detail. The Committee decides that before taking final decision following documents/clarifications are required to be submitted by the institution :-

1. The institution be asked to explain about the following discrepancies in the land documents:-

1. As per the para 3 of para 1 of the English version of the Title Deed “the said land schedule property corresponding to by way of a registered gift deed being No. 5393/09 dt.10.9.2009 in favour of Ushangini College of Education for Women” whereas

2. As per para 2 of the para 2 of the English version of the Tile Deed reads as “From today owner of this property will be Miss Sampati Pramanik , Secretary of the Ushangini College of Education for Women”.

2. The Govt. of West Bengal school Education Department (Primary Branch) not recommended for conducting two years D.El.Ed course.

The institution shall submit the above details/ clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.

In view the NCTE Hqr. letter No.F.48-2/2011/NCTE/N & S (PT) A37157 dated 1st June, 2011, the ERC decides that a show cause notice be issued under clause 7(1) of NCTE Regulations, 2009 as to why their application be not summarily rejected giving the institution 21 days time.

The Committee deliberated and considered the case in detail. The Committee decides that before taking final decision following documents/clarifications are required to be submitted by the institution :-

1. Notarized copy of the Land Use Certificate to be countersigned/issued by the competent authority.

2. The institution is required to appoint part time faculty as a Director of Physical Education.

3. A list of qualified faculty duly appointed as per the provisions of the NCTE Regulations 2009 indicating qualification, percentage of marks, teaching experience etc. countersigned by the Registrar of affiliating university alongwith attested copy of professional qualification & experience certificate (as per the format enclosed) alongwith details of joining of each faculty member.

4. Details of salary components and salary paid to teachers as per clause 4 (V)(d) /4(IV)(d) of NCTE Norms for B.Ed. and D.Ed. course with supporting documents i.e. statement towards payment of salary through bank alongwith a copy of a Acquittance roll of teachers showing payment of salary as per the NCTE norms.

The institution shall submit the above details/ clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.

Hence the ERC decides to seek above details/clarification under clause 8(11) of the NCTE Regulation, 2009 on the above points and direct the institution to submit the reply as per provisions of the NCTE Act, Rules & Regulations within 21 days.

The Committee deliberated and considered the case in detail. The Committee noted that the Department of Education, Vinaya-Bhawan (Institute of Education), Visva-Bharti is continuing B.Ed. programme since 1948 having NCTE approval vide order No. ERC/7-111.4.1.2/2010 dated 22nd Sept., 2010 with intake capacity of 100. The Govt. of India, in the admission policy, clearly states that 15% seats may be admitted as supernumerary in the Central Universities. Visva-Bharti is a Central University and one candidate from Bangladesh applied for admission to B.Ed. course in 2011-12 session as a Supernumerary candidate.

Keeping in view of the above, the Committee decides that the University be permitted to admit one foreign candidate in the B.Ed. Course in 2011-12 session as a Supernumerary candidate by increase one seat i.e. 100+1.
