PROCEEDINGS OF 122nd MEETING OF THE ERC-NCTE HELD ON 28th - 30th July 2011

The 122nd Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 28th – 30th July, 2011 at Conference Hall, ERC, NCTE, 15, Nilakantha Nagar, Nayapalli, Bhubaneswar.

In pursuance of the Gazette Notification No. 121 dated June 2, 2011 in exercise of powers conferred under Section 21(2)(b) of the NCTE Act, 1993 read with Clause 4 of Regulations No.F.28-14/95, dated 22nd January, 1996, Prof.(Dr.) P. C. Mahapatra has been nominated as Chairperson of the Eastern Regional Committee, Bhubaneswar. The Chairperson and Convener were present.

           The Regional Director apprised the Chairperson, ERC about the provisions of the NCTE Act, Rules & Regulations and instructions issued from time to time. With the permission of Prof.(Dr.) P. C. Mahapatra, Chairperson, Dr. Ram Kishor (Convener) presented the Agenda for perusal and suitable decision as per provisions of the NCTE Act, Rules & Regulations before the Committee

The Eastern Regional Committee after going through the original file of institutions, reply received from the NCTE Hqrs. viz-a-viz provisions of the NCTE Act, Rules & Regulations considered all the agenda items placed before the ERC in its 122nd meeting. Item-wise decisions taken are as follows:

The Committee noted that the Appellate Authority had confirmed the order of ERC refusing recognition.

Ganauri Ramkali Teachers’ Training College, Nawada, Vill-Industrial Area, Police Line, Po-Mahanandpur, City/Dist-Nawada, Bihar (Code No.APE001034)

The Committee noted that the Appellate Authority had reversed the withdrawal order of ERC with a direction to restore recognition to the institution and hence, decided that the Order restoring the recognition of the institution be issued as per the directions of the Appellate Authority.

       

ERC 122.7 Court Cases

ER-122.7.1

CWJC No.10607 of 2006 filed by Sayed Sadih Akhtar & Ors-vs-L.N. mithila University & Ors in the Hon’ble High Court at Patna. (F.No.ERC/05-262/2006)

The original file of the institution viz-a-viz provisions of the NCTE Act, Rules, Regulations and guidelines issued by NCTE-HQrs from time to time were considered by ERC.

The Committee noted that as per the direction of the Hon’ble High Court Patna, ERC has constituted an enquiry Committee consisting of two experts Dr. S. N. Kumar & Dr. K. M Lahiri. They had submitted their report which was received on 21st July 2011 at ERC office which was vetted by the Regional Director as per the order of the Hon’ble High Court. As per the order of the Hon’ble High Court, Patna the report as well as all the relevant enclosures may be sent to concerned Learned Counsel to place the matter before the Hon’ble Court, Patna.

The ERC also decides that basing on the report of the enquiry Committee, the institution be issued Show Cause Notice u/s 17 on violation of Section 8 (14) & 8 (15) of the NCTE Regulations 2009, which reads as under :-

8 (14) : The institution shall make the information or documents available to the National Council for Teacher Education or its authorized representatives as and when required by them. Failure to produce or show any of the required documents, shall be treated as a breach of the conditions of recognition

8 (15) : The institution shall maintain records or registers and other documents etc which are essential for running of an educational institution especially those prescribed in the relevant norms and standards and guidelines or instructions or rules etc of the Central or State or Union Territory Governments, affiliating or examining bodies.”

The institution shall submit the above details/ clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.

Hence the ERC decides to seek above details/clarification under section 17 of the NCTE Act on the above points and direct the institution to submit the reply as per provisions of the NCTE Act, Rules & Regulations within 21 days.

ER-122.7.2

W.P. No. 19384 (w) of 2009 filed by Sidra B.Ed. College & Others vs. Regional Director, NCTE, ERC & Others in the Hon’ble High Court at Calcutta (F.No.ERC/05-438/2009)

The original file of the institution vis-à-vis provisions of the NCTE Act, Rules, Regulations and guidelines issued by NCTE-HQrs from time to time were considered by ERC.

The Committee noted that the directions of the Hon’ble High Court were considered by ERC in its 120th meeting held on 24th-25th June 2011, wherein the ERC decided to issue clarification letter on the institution on certain points.

However, the matter was re-considered by ERC in light of directions of NCTE-HQrs vide letter No. F.64-224/2009/NCTE/Legal A39783 dt.19.07.2011 wherein the HQrs had directed that an appeal in the instant case may be made before the concerned Hon’ble High Court. Accordingly, as per the direction of the NCTE-HQrs, the ERC decided that an Appeal be filed before the Hon’ble Court and the concerned learned Counsel be requested to take appropriate steps in this regard.

ER-122.7.3

W.P.(C) No.5686 of 2010 filed by R.S. College of Education -Vs- NCTE & Ors. In the Hon’ble High Court at Ranchi.

The original file of the institution vis-à-vis Hon’ble Court directions dated 09.06.2011 and provisions of the NCTE Act, Rules, Regulations and guidelines issued by NCTE-HQrs from time to time were considered by ERC.

The ERC noted that the petitioner institution has preferred an LPA against the order dated 09.06.2011 and since the matter is sub-judice before the Hon’ble High Court, the Committee will take decision after the disposal of the said LPA filed by the institution.

The Committee noted that a show cause noticed was issued to the institution under clause 7(1) of NCTE Regulations, 2009, the Committee considered the reply of the institution and deliberated the case in detail as per provisions of the NCTE Act, Rules & Regulations. The Committee noted the following:-

  1. The institution in its reply had stated that the land is registered in the name of Exalt Educational Trust through the Registered Sale Deed – vide document No. 7746 executed on 6th Sept 2010 and had attached a copy of sale deed. The said contention of the institution creates a doubt that either one of the sale deed is tampered i.e. either the earlier one or the present one as both the sale deeds have been registered on the same date, with the same stamp paper no. i.e. 507183 and even under the same document number. The earlier sale deed does not makes a reference of the society name whereas the present one makes a reference of the name of Society.

Therefore, the contention of the institution that the land documents submitted earlier due to typographical error of the deed writer is not acceptable. It appears that the document is tempered.

In view of the above the reply of the institution was not found to be satisfactory, therefore, the ERC decides that the application of the institution be summarily rejected under clause 7(1) of the NCTE Regulations, 2009.

The Committee noted that a show cause noticed was issued to the institution under clause 7(1) of NCTE Regulations, 2009, the Committee considered the reply of the institution and deliberated the case in detail as per provisions of the NCTE Act, Rules & Regulations. The Committee noted the following:-

  1. The institution has mentioned in its representation dt. 13th July 2011 that the institution had submitted On-line application dt. 30.09.2010 & the Challan of Rs. 40,000/- was deposited on 1st October, 2010.The application copy in triplicate of the on-line application was submitted in ERC office on 8th October 2010, in Person, as there was a delay in postage as 2nd October being a National Holiday and 3rd October being Sunday.

The Committee, therefore, noted that the institution has not dispatched/ submitted the applications within 7 days, therefore not complied with the provisions of the NCTE Regulations, 2009.

In view of the above the reply of the institution was not found to be satisfactory, therefore, the ERC decides that the application of the institution be summarily rejected under clause 7(1) of the NCTE Regulations, 2009.

The Committee noted that a show cause noticed was issued to the institution under clause 7(1) of NCTE Regulations, 2009, the Committee considered the reply of the institution found the same to be satisfactory ,therefore, the ERC decides that the application of the institution be processed further by deputing the Visiting Team so as to verify the infrastructure & instructional facilities of the institution as per provisions of the NCTE Regulations, 2009.

As per provisions of the clause 7(4) of the NCTE Regulations, 2009, the institution shall be required to provide details about the infrastructure etc. on the duly filled up proforma available on ERC, NCTE website to the Visiting Team at the time of inspection along with building completion certificate by the competent authority and an undertaking as per the prescribed format. The Committee noted that a show cause noticed was issued to the institution under clause 7(1) of NCTE Regulations, 2009, the Committee considered the reply of the institution and deliberated the case in detail as per provisions of the NCTE Act, Rules & Regulations. The Committee decided that the institution be asked to submit the following documents :-

  1. Certified copy of registered land documents as per provisions of the NCTE norms.

  2. Site Plan showing the land details of the institution.

  3. Notification of upgradation of ST School, Sonepur into DRC

  4. Certificate that B.Ed will be run as an additional course in DRC Campus

The Committee decided that the institution be asked to submit the following documents :-

  1. Certified copy of registered land documents as per provisions of the NCTE norms.

  2. The built up area is 11838 sq.ft as per the building plan submitted by the institution is less than the required as per the NCTE norms for additional course.

  3. Certificate from the institution that the B. Ed course will be an additional course in DIET Campus

  4. The institution not submitted the certificate from the State Authority / Incharge of Teacher Education Department, as desired by ERC regarding land & building as per NCTE norms.

  1. The institution had not submitted the certificate from the State Authority / Incharge of Teacher Education Department, as desired by ERC regarding land & building as per NCTE norms.

  2. The institution is required to submit a certificate that the application is meant for additional (B.Ed) course to be run in the DIET Campus

The institution shall submit the above details/ clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.

The Committee noted that a show cause noticed was issued to the institution under clause 7(1) of NCTE Regulations, 2009, the Committee considered the reply of the institution and deliberated the case in detail as per provisions of the NCTE Act, Rules & Regulations. The Committee decided that the application of the institution be processed for further course of action for issuance of deficiency letter, if any as per provisions of the NCTE Regulation, 2009.

Further, the ERC decided that a letter / notification of the competent authority of the State Govt. for revival of 2 years diploma in elementary education in DIET, Bhagalpur as Pre Service Primary Teacher Education Programme has been seized since 1993 be called for from the institution.

The Committee also decides that a copy of the letter be also sent to the Principal Secretary, HRD Department, Govt. of Bihar for kind information & suitable necessary action.

DIET Baripada, Mayurbhanj, Orissa (Govt.) (Board of Secondary Education) (Code No. ERCAPP745)

The Committee noted that a show cause noticed was issued to the institution under clause 7(1) of NCTE Regulations, 2009, the Committee considered the reply of the institution and deliberated the case in detail as per provisions of the NCTE Act, Rules & Regulations. The Committee decided that the institution be asked to submit the following documents :-

  1. The built up area of the institution is 435 sqm, which is less than the required as per Regulations for additional course.

  2. A certificate from the institution / competent authority that the application is meant for an additional B.Ed course in DIET Campus.

The institution shall submit the above details/ clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.

Hence the ERC decides to seek above details/clarification under section 14(3) (b) of the NCTE Act on the above points and direct the institution to submit the reply as per provisions of the NCTE Act, Rules & Regulations within 21 days.

  1. The institution has not submitted the land documents issued by the competent authority as per NCTE norms. It is also observed that no date is indicated by the signatory of the Assignors and Assignee and the witness in the documents.

In view of the above the reply of the institution was not found to be satisfactory, therefore, the ERC decides that the application of the institution be summarily rejected under clause 7(1) of the NCTE Regulations, 2009.

Donee in one place is written as Monarck College of Education under the management of Monarch society of art and technology at another page it is written Konark college of education which is under the management of Konark Society of Art and Technology.

  2. The Donee Sh Mriganka Mandal is also doner and his position in relation to institution & society in land documents is not clear (in English Version). Status of Mriganka Mandal be clarified.

  3. Notarized copy of change of land use certificate issued by the competent authority not submitted.

The Committee noted that a deficiency letter was issued to the institution. The Committee considered the reply of the institution and deliberated the case in detail as per provisions of the NCTE Act, Rules & Regulations. The Committee decided that the institution be asked to submit the following documents :-

  1. The State Govt. of West Bengal has not recommended grant of recognition for the said course to the institution.

  2. Notarized copy of Change of land use certificate issued by the competent authority not submitted.

  3. Building plan prepared by approved engineer / architect and countersigned by the competent Govt. authority / local body not submitted by the institution.

  4. Certificate from the registering authority clearly indicating provisions of Act / law under which the trust / society has been registered not submitted.

The ERC also and noticed that as per the Memorandum of Association of the Society submitted it is seen that Sh. Ananda Mohan Biswas, Sipra Biswas and Firoja Begum are the members in both the societies. Sh. Ananda Mohan Biswas is a President in ERCAPP499 and Asst Secretary in ERCAPP500. Ms. Sipra Biswas is a President in ERCAPP500 and Member in ERCAPP499. Ms. Firoja Begum is a Secretary in ERCAPP500 and Member in ERCAPP499.

From the above documents, the ERC is of the view that one group of members have submitted two application for B.Ed (ERCPP499) and D.El.Ed (ERCAPP500) courses, which is not permissible as per clause 8 (2) of NCTE Regulations 2009.

By registering two different societies with the same members, it has simply tried to avoid the clause 8 (2) of NCTE Regulations 2009, wherein it has been stated “In the first instance, an institution shall be considered for grant of recognition of only one course for the basic unit as prescribed in the norms and standards for the particular teacher education programme”

In view of the above, the ERC decided that a letter of request be addressed to the Secretary, Education, Govt of West Bengal stating the above facts and requesting to indicate as to whether as per the policy of the State Govt, these type of institutions are considered as a separate entity or a single entity as per the law of the State.

The ERC found that in the Conversion of land, Building Plan and Affidavit submitted by both the institutions are same with reference to Plot No / Khata No / JL No.

The ERC also noticed that as per the Memorandum of Association of the Society submitted by both the societies two members namely Sri Bimalendu Kundu and Dalu Kundu are common in both the societies.

From the above documents, the ERC is of the view that one group of members have submitted two application for B.Ed (ERCPP550) and D.El.Ed (ERCAPP542) courses, which is not permissible as per clause 8 (2) of NCTE Regulations 2009.

By registering two different societies with the same members, it has simply tried to avoid the clause 8 (2) of NCTE Regulations 2009, wherein it has been stated “In the first instance, an institution shall be considered for grant of recognition of only one course for the basic unit as prescribed in the norms and standards for the particular teacher education programme”

In view of the above, the ERC decided that a letter of request be addressed to the Secretary, Education, Govt of West Bengal stating the above facts and requesting to indicate as to whether as per the policy of the State Govt, these type of institutions are considered as a separate entity or a single entity as per the law of the State.
