Confirmation of the Proceedings of 122nd ERC meeting, 28th-30th July 2011 at Bhubaneswar.

The ERC noted that the NCTE-HQrs vide letter No. 40-1/2011/NCTE/CDN dated 11th August 2011 it was informed that the ERC may go ahead with the decisions contained in the 122nd meeting while ensuring that the decision correctly reflect the facts on record and all the decisions are in accordance with the provisions of the NCTE, Act, Rules and Regulations as mended from time to time and the instructions issued by the NCTE (Hqrs) from time to time.

The Committee noted and endorsed the decision of Convener in initiating the process of implementing the decision of 122nd meeting of ERC as per the spirit of the decision taken by the ERC.

3. Building plan prepared by the approved Civil Engineer / Architect and certified by the competent Govt authority not submitted by the institution.

The institution shall submit the above details/ clarification alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points.

Hence the ERC decides to seek above details/clarification under section 14(3) (b) of the NCTE Act on the above points and direct the institution to submit the reply as per provisions of the NCTE Act, Rules & Regulations within 21 days.

As the case of applicant for opening B.Ed coruse of the institution has already been processed, hence, the ERC decided that the application of this institution for opening D.El.Ed course be refused.

The matter was placed before the ERC in its 123rd ERC meeting. It was decided that as it leads to contempt case urgent step may be taken for sending Visiting Team as per direction of Hon’ble High Court, Patna to Magadh Teacher Training College, Gaya, Bihar.

As the withdrawal order has been confirmed by the Appellate Authority, NCTE-HQrs, New Delhi vide order dated 05.05.2010, this matter be reported to NCTE-HQrs for post facto approval. Action may be taken immediately under intimation to NCTE-HQrs.
