The Committee deliberated and considered the case in detail and on the basis of order of the Appellate Authority, the Committee decides that Letter of Intent prior to recognition under Clause 7(9) of NCTE Regulations 2009 be issued asking the institution to submit the following documents :-

1. Advertisement in leading newspapers.

2. Letter of University / Affiliating Body, nominating experts / representative for the Selection Committee.

3. Minutes of the Selection Committee duly constituted as per the norms of the affiliating body.

4. Approval of the University / Affiliating body to the selected faculty in prescribed format. (copy enclosed)

5. An Affidavit on Rs.100/- stamp paper to the effect that the institution has selected staff as per NCTE/ State/ University norms. (format enclosed)

6. An affidavit on Rs.10/- non judicial stamp paper by the individual faculty member selected by the institution. Details should be filled in by every faculty member selected (format enclosed)

7. Educational & Professional qualification certificates of all teaching staff showing their eligibility for appointment as per the NCTE norms and experience certificate of the Principal/HOD.

8. Account opening form duly filled in for conversion of FDRs into joint account or document establishing that the FDR of Endowment Fund and Reserve Fund have been converted into a joint account.

9. An undertaking from the Management of the institution as per the format enclosed.

10. Down loaded copies of the website of the institution with the hyperlink of the same as per provisions of 7(10) of the NCTE Regulations, 2009.

The institution after appointing the requisite faculty or staff as per the provisions of sub-regulations 7 (9) and after fulfilling the conditions under sub-regulation 7 (10) shall submit its compliance alongwith all necessary documents accompanied with an Affidavit in support of reply of the above points within 30 days of issue of Letter of Intent prior to recognition.

1. The institution is requested to submit a letter from the concern Deptt. that the Govt. has taken appropriate steps for construction of a Multipurpose Hall of the size of 2000 sq.ft. as per NCTE norms.

The institution shall submit the above details/ clarification along with all necessary documents accompanied with an Affidavit in support of reply of the above points.

Hence the ERC decides to seek above details/clarification under section 14(3) (b) of the NCTE Act on the above points and direct the institution to submit the reply as per provisions of the NCTE Act, Rules & Regulations within 21 days.

The original file of the institution, directions received from NCTE-HQrs viz-a-viz provisions of the NCTE Act, Rules, Regulations and guidelines issued by NCTE-HQrs from time to time were considered by ERC.

The Committee noted that the NCTE-HQrs vide letter No. 61-1/2011/NCTE/Acad/A41158 dated 19th August 2011 had intimated that the Standing Committee in its meeting held on 03rd and 04th August 2011 had approved the proposed B.A.B.Ed (4 years Integrated) programme proposed by the institution and decided that the application of the institution be processed further by deputing the Visiting Team so as to verify the infrastructure & instructional facilities of the institution as per provisions of the NCTE Regulations, 2009.

The ERC decides that before taking further action on the basis of complaint the institution be asked for comments on the complaint and send a copy of the updated list of the faculty duly countersigned by the Registrar of the affiliating university.

ER-126.9.2.3

Complaint received from Ms. Manorama Kumari, Jharkhand

The ERC decides that in view of the provisions Norms & Standards for B.Ed. Programme 3.(2) eligibility, the reservation in seats & relaxation in the qualifying marks in favour of the reserve categories shall be as per the rules of the concern Govt.

The ERC also decides that Principal of the both the institutions be asked to give their comments on complaints given by the Ms. Manorama Kumari.

ER-126.9.2.4

Complaint received from Sh. Ashok Kumar Gosh, Sahebganj, Bihar

The ERC decides that the copy of the complaint given by Ashok Kumar Ghos may be sent to the Registrar, S.K.M, University, Dumuka, for information and comments. The university authority is requested to refer to the Norms & Standards for B.Ed. programme leading to B.Ed. Degree as per NCTE Act 1993 and Regulation 2009.

University authorities are requested to take appropriate steps in this regards.

Complaint received in ERC on on 22nd June 2011 & 15th July 2011 from Sh. Binod Kumar Singh, Gaya, Bihar against Jharkhand Teacher Training College, Jharkhand

The recognition of the institution has already been withdrawn vide order dated 6th April 2011 and same was also confirmed by the Appellate Authority vide order dated 10.01.2011.

The Committee deliberated and considered the case in detail and decided that since ERC had withdrawn recognition of the institution vide order No. ERC/7.116.2.10/2011/6926 dated 6th April 2011, the decision taken by the ERC and Appellate Authority stands as on date.

The original file of the institution viz-a-viz provisions of the NCTE Act, Rules, Regulations and guidelines issued by NCTE-HQrs from time to time were considered by ERC.

The Committee noted that a letter was issued to the institution vide No.8050 Dt.26.07.2011 and reply received in response to the letter were placed before the ERC. The Committee considered the reply of the institution and deliberated the case in detail as per provisions of the NCTE Act, Rules & Regulations and decided that application of the institution be processed further as per NCTE Rules and Regulations.

ER-126.9.5.1

Magadh Teacher’s Training College, West Church Road, Near D.M. Residence, Dist – Gaya, Bihar – 823001 (B.Ed) (Private) (Magadh University) (Code No. APE00422)

As per the direction of Hon’ble High Court of Patna the inspection of the institution was conducted on 12.09.2011 & 13.09.2011. The VT report was considered by the Committee and following observations were made.

The ERC noted that as per the directions of the Hon’ble High Court, the Visiting Team was constituted and Visiting team had submitted the report to ERC. The ERC after going through the deficiencies pointed out by the ERC vide order No. ERC/7-103.6/2009/2975 dated 14th January 2010 whereby the recognition of the institution was withdrawn and the VT report as per the directions of the Hon’ble High Court viz.viz NCTE Act, Rules and Regulations, the Committee come to the conclusion that the institution is still deficient on account of following deficiencies :-

1. As per the Xerox copy of the sale deed the society possesses 32 decimal of land which is less than the required 2500 sq.mts.

2. The original sale deed was not produced before the VT members, which is a breach of para 8 (14) of NCTE Regulations 2009.

3. The management was unable to produce the Land Mutation / Possession Certificate in Original.

4. The size of Multipurpose hall is 1080 sq.ft, which is less than the required 2000 sq.ft as per NCTE Norms and Regulations 2009.

5. The identity of the institution is not clear as the name of the college was not written permanently in any place of the building, but it is written in a Banner which was placed at the main gate.

6. The Accounts of the institution was not furnished to Visiting Members at the time of inspection, which is a violation of para 8 (14) & 8 (15) of NCTE Regulations 2009.

7. As per the VT Report, during the period of visit, it is observed that there is no co-ordination among the members of the Managing Committee.

8. There is inadequate open space for outdoor games.

9. The Principal is not qualified as per existing NCTE norms & standards 2009. As the Principal has no Ph.D in Education and less percentage of marks in Master’s Degree in School Subject-48.9% whereas the required marks is 50%.

10. Suggested list of teaching staff submitted by the institution dated on 13.09.2011 is not countersigned by the Registrar / Competent authority of the affiliating body which is not acceptable as per the NCTE Norms and Standards 2009. Except three faculty members, other staff including part time staff are not qualified as per NCTE Regulations 2009.

11. As per the VT report, no record of attendance of teaching staff of the college is available from 1.6.2010 to till date.

12. The permission of the competent authority to use the land exclusively for Educational Purposes (CLU) is not submitted to the VT members.

13. The building plan could not be furnished to V.T. members to verify the details of infrastructure given by the institution as same as the building plan approved by the competent authority.

14. The building completion certificate was not furnished to V.T. members to match with the approved building plan and the land document of the building inspected are same.

15. Safe guard against the fire hazard has not been provided in the building as per VT report.

16. The institution’s campus, building, furniture is not disabled friendly.
    

In view of the above the Committee perusing the overall facts and figures and report of the Visiting Team constituted as per the directions of the Hon’ble High Court, the Committee is of the view that the recognition withdrawn by the ERC vide its order dated 14th Jan 2010 stands valid as on date.
