After considering the records available in the file, relevant provisions, and after going through the letter from NCTE HQr dated 22/3/2012 i.r.o. the dissent letter from ERC Member Dr Shukla Mahanty regarding the Netaji Subhas Institute for B.Ed in its 131st ERC meeting, the committee deliberated in detail and resolved unanimously to stand on the decision taken in its 131st meeting, however Dr. Shukla Mahanty maintained her old stand for the decision taken  in 131st ERC Meeting.

The State representative of Govt. of West Bengal will verify the point of Show Cause Notice and intimate to ERC for further appropriate decision. Copy of the Show Cause Notice dated 11.8.2011 be made available to the ERC State Government Representative of West Bengal.

During confirmation of 131st ERC meeting minutes the committee observed that the application of the institution has been refused on ground of delay in submission of hard copy, but on verification of dispatch proof provided by State Representative of West Bengal before the Committee; the ERC is satisfied that the hard copy was dispatched within 7 days of electronic online submission.

In view of the above observation, after considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules , Regulations and guidelines issued by NCTE HQr, before confirmation of 131st decision i.r.o the application No ERCAPP1035, the Committee withholding its decision taken in 131st ERC meeting, decided to process the application on merit and issue deficiency letter.

Both the institutions are Government institutions, hence Committee is satisfied with the infrastructure requirement and decided to issue Letter of Intent under Clause 7(9) of NCTE Regulations 2009 for B.Ed. Course.

(i) The institution submitted the same Building plan approved by Anchal Adhikari again, which was submitted earlier, the building plan indicating details of plot/khasra number, builtup area with approval of competent civil authority is not submitted yet.

(ii) Site plan approved by concerned Govt. authority, demarcating the different plots to mark the contiguity where the institution is proposed is not submitted.

(iii) Original F.D.R. of Rs.5.00 lakh and Rs.3.00 lakh is not submitted.

(iv) Enclosure reg. col. 5 of the affidavit from competent Govt. authority not submitted.

Hence the ERC decided to issue show cause Notice under section 14(3) (b) of the NCTE Act on the above points before taking appropriate decision and direct the institution to submit the reply as per provisions of the NCTE Act, Rules & Regulations within 21 days.

The ERC in its 130th meeting decided to issue Letter of Intent under clause 7(9) of NCTE regulation to the applicant institution for B.Ed. The ERC office before implementing the decision of ERC received the complaints against the institution addressed to Member Secretary NCTE New Delhi, the same was also forwarded from NCTE HQr. for necessary action.
After perusal of the complaints, the committee deliberated in detail, reviewed the VT Report/video recording thoroughly and decided to maintain the earlier decision taken in 130th ERC meeting, the committee also decided that affiliating University be requested to verify that no other courses are running in the same building of teacher training institute and intimate to the office of ERC accordingly while approving the list of faculty members.
