132nd Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) held on 3rd - 4th April, 2012 at Conference Hall, ERC, NCTE, Bhubaneswar

Before confirmation of the Minutes of 132nd Meeting, the Govt. Representative of West Bengal invited the attention on decision in respect of application No: ERCAPP923 of Loreto St. Mary RC PTTI, P.O-Tangra, Kolkata for the course D.El.Ed wherein scrutiny of the application for deficiency as per provisions of the NCTE Act, Rules & Regulations was proposed and the State Representative of West Bengal was requested to clarify whether the institution is Govt. or Private. The State representative of West Bengal stated that being Govt. Institutions and Initiative of Government of WB in the light of RTE Act, the inspection of institution be conducted to ascertain the availability of infrastructure. Members of the Committee agreed that before confirming the Minutes, the decision in respect of the Application ERCAPP923 be modified as “VT be sent for inspection”.

The proceedings of 132nd Meeting of the ERC, NCTE held on 3rd -4th April, 2012 are confirmed.
 
The Committee also decided as under:

•  The Regional Director will be requested to prepare a State Wise and Year Wise status of processing (Data Base/Report) of all the institutions and make available to all the members of the Committee in its next meeting.
•  All the cases of applications which are pending and submitted prior to enforcement of Regulations 2009 shall be placed before the Committee in its next meeting.

The office may confirm the joint operation of FDRs of Rs.5 lakh and Rs.3 Lakh before issuing Recognition Order.

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs, and the reply of the institution in response to the Letter of Intent, the Committee discussed the matter in detail on the qualifications of the Principal observed as under:

The experience of the Principal is not as per the NCTE Norms. The experience of the duration from 1st April 2004 to 16th September 2009 is not from the NCTE recognized Teacher Education Institution.

The institution be directed to appoint a Principal having qualifications and experience as per NCTE Regulations 2009 following due procedure.

In view of the above the Committee decided that the clarification letter be issued to the institution to submit the reply in compliance of the above within one month.

133.6.3

Prabhat Jyotirmoyee College of Education, Plot No.-535, 536, 537, /1020 Street No.-Suri – Asansol, Vill-Abdarpur, PO-Suri (Barbagan), Tehsil/Taluka-Suri, Town/City-Suri, Dist-Birbhum (WB), Pin-731103,  State-West Bengal (D.El.Ed.) After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs, and the reply of the institution in response to the Letter of Intent, the Committee discussed the matter in detail on the faculty appointed by the institution, the Committee observed as under:

Institution is required to appoint one Lecturer in methodology (Mathematics) following due procedure.

In view of the above the Committee decided that the clarification letter be issued to the institution to submit the reply in compliance of the above within one month.

133.6.4

Renukadebi College of Education, Vill – Barakulberia, PO – Barakulberia, West Bengal – 741150 (D.El.Ed.) (Private) (West Bengal Board of Primary Education) (Code No. ERCAPP316)

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE HQr, and the reply of the institution in response to the Show Cause Notice regarding staff list. The Committee after detailed discussion observed as under:

• The experience of the Principal is not as per NCTE Norms for D.El.Ed Programme. The experience of 5 years is not from Primary/Elementary Teacher Education Institution.
• The institution is required to appoint a Principal with requisite qualification as per NCTE Regulations 2009.
• The staff list submitted is notarized photocopy, the original staff list approved by the affiliating body be submitted.

In view of the reply of the Show Cause Notice dated 12th March 2012 and the above observations, the committee decided to issue show cause notice to the institution as to why the Recognition of the institution for D.El.Ed.  Course be not refused on the above points. The Committee therefore, provides an opportunity under section 14(3)(b) of the NCTE Act, 1993 to the institution to submit its reply  within 21 days before the Committee takes final decision.

133.6.5

Dr. Ambedkar PTTI, Vill- Gobindapur, PO – Juginda, Dist – Murshidabad, West Bengal – 742406 (D.El.Ed) (Private) (West Bengal Board of Primary Education)    (Code No. ERCAPP331)

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs, and the Notice regarding staff appointed vide clarification letter dt. 30.11.2011 wherein the institution was asked to submit clarification on the following points within 21 days:

• Experience of the Principal is not as per not NCTE Norms.
• List of the approved staff is not signed by the West Bengal Board of Primary Education.
• Testimonials of other teaching staff are not attested/notarized.

The institution did not submit any reply to the clarification dated 30.11.2011 on the above points.

The Committee, therefore, decided to issue Show Cause Notice to the institution as to why the recognition of the institution be not refused on the above points. The Committee therefore, provides an opportunity under section 14(3)(b) of the NCTE Act, 1993 to the institution to submit its reply  within 21 days before the Committee takes final decision.

133.6.6

Teachers Training College, Bhagalpur, Vill/PO-Barari, City- Bhagalpur, Dist.- Bhagalpur, Bihar- 812003 (B.Ed.) (Private) (TMBU Bhagalpur)                          (Code No. ERCAPP227)

The committee observed the following discrepancies in the submitted document:

•   Plot No. in fresh plan is 1/192 and 2/440 whereas in original land document it is 1/930, 2/930 and 2/440.
•   Site plan and building plan must be approved by the Govt. Engineer.

Since the institution had already been issued clarification Notice dated 29.12.2011, therefore the institution be given last opportunity  as to why the recognition of the institution be not refused on the above grounds under section 14(3)(b), hence the ERC decided to issue Show Cause Notice under section 14(3) (b) of the NCTE Act 1993 on the above points before taking appropriate decision and direct the institution to submit the reply as per provisions of the NCTE Act, Rules & Regulations within 21 days.

• The institution submitted the same document as submitted earlier instead of original FDRs of Rs.5 lakh and Rs.3 Lakh.
• The institution submitted land use certificate signed by Anumandal Padadhikari without seal and same is silent about conversion of land from agriculture to non-agriculture purpose.

In view of the clarification letter sent and the reply submitted by the institution the Committee is of the view that institution has not fulfilled the necessary conditions despite the opportunity given, it is, therefore the Committee decided that application of the institution regarding recognition for B.Ed. Course is refused under section 14(3)(b) of NCTE Act 1993 on the ground of the deficiencies pointed above.

• The institution has not submitted the Mutation Certificate.

• The institution has not submitted the non-encumbrance certificate.
• The building plan submitted by the institution is not countersigned by the competent Govt. authority as per NCTE Norms.
• Institution itself accepted that the built up area is not sufficient at present.

The Committee observed that the reply of Show Cause Notice under section 14(3)(b) is not received so far. In view of this, the committee decided that the Recognition of the institution for D.El.Ed.  Course be refused on the above grounds under section 14(3)(b) of the NCTE Act 1993.

133.9.16

Sukhdeo Narayan Lal Bahadur Sitaram Memorial B.Ed. College, Plot No. 4753, Vill. – Mustafapur, Po.– Malti, Tehsil/Taluka – Asthwan, Town/City – Biharsharif, Dist. – Nalanda, Bihar – 803 107. (B.Ed) (Private) (Magadh University) (Code No. ERCAPP844)

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs., and the reply of the  deficiency letter dated 20.01.2012  the Committee observed that the institution has not submitted the following:

• The institution has submitted photocopy of confirmation of deposit which was already submitted earlier instead of submitting original FDRs towards Endowment Fund and Reserve Fund.

133.9.17

Santipur Primary Teachers Training Institute, Vill-Babla Dakshinpara, Tehsil/Taluka-9 santipur, Town/City-Santipur, P.O-Babla Gobindapur, Dist-Nadia, West Bengal-741404 (D.El.Ed) (Private) (West Bengal Board Of Primary Education) (Code No. ERCAPP1136)

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs., and the reply of the deficiency letter the Committee observed that the institution has also applied for D.El.Ed course vide application No: ERCAPP741.

As per NCTE Regulations 2009 an institution would be considered for recognition of one basic unit of one programme. Therefore, both the applications vide ERC APP 1136 and ERCAPP741 for the same course by the same institution cannot be processed simultaneously.

In view of this, the Committee decided that institution be asked to select either one of the two applications to be processed onwards. The institution will submit its choice within 15 days of the issue of letter. If the reply is not received within stipulated time the Committee would free to process appropriate application.

133.10.1

New Delhi and the reply of Notice under clause 7(1) dated 30.11.2011 wherein the clarification regarding Govt. lease between Governor of the State and Mr. Somnath Chakraborty was sought. The Committee observed that Mr. Somnath Chakraborty being the Chairman of the Sarthak Educational Trust has signed the lease and therefore as per lease document the land was in favour of Sarthak Educational Trust for the purpose of setting of educational institute. The lease is for 99 years and the land is free from all encumbrances.

In view of the above observations the Committee decided that application be scrutinized for deficiencies as per NCTE Regulations 2009.

133.10.2

Dhubulia College of Education, Plot No.- 2698, Street/Road- 2698, Vill/Po.- Dhubulia, Tehsil/Taluka- Krishnanagar, Town/City- Krishnanagar, Dist- Nadia, West Bengal – 741139 (B.Ed) (Private) (University of Kalyani) (Code No. ERCAPP634)

After considering the records available in the file and relevant provisions of NCTE Act, 1993, Rules, Regulations and guidelines issued by the NCTE Hqrs. New Delhi and the reply of Notice dated 3.10.2011 submitted by the institution wherein the institution has requested to withdraw its application since the applicants is unable to comply with the NCTE Norms. The institution has also requested to return FDRs of 5 lakhs and 3 lakhs.  The Committee after detailed discussion accepted the request of the institution but before dropping the proposal it is necessary to submit the resolution of the Society/Trust to withdraw application submitted. Therefore, the Committee decided that the institution be requested to submit the resolution of the Society/Trust in this regard.

After considering the records available in the file and relevant provisions of NCTE Act, 1993, Rules, Regulations and guidelines issued by the NCTE Hqrs. New Delhi and the reply of the Notice under clause 7(1) dated 8.2.2012 wherein it was justified that online application was submitted on 30.9.2011 and the challan was submitted in the Bank on dt.1.10.2011 as 30th September being a Bank’s half yearly closing day and it was beyond the control of the applicant’s to deposit the fee on the same day. The institution also submitted its reply on the point-2 of the Show Cause Notice where it has claimed that St. Mary Technological Foundation is a licensed Company under section 25 of the Company’s Act 1956.

The NCTE Regulations under clause 4 of Rule 4 describes that institutions established and operated by non-for profit societies and trust registered under appropriate laws are eligible to apply.

In view of this the Committee decided to refer the case to NCTE Hqrs. for direction on the issue whether the institution registered under section 25 of the Company Act 1956 comes under clause 4 of Rule 4 of NCTE Regulations 2009.

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs, and the reply of the institution in response to the Show Cause Notice dated 1.2.2012 under clause 7(1) of NCTE Regulations 2009, the Committee observed as under:

• Land is in the name of individual not in the name of trust or institution.
• Building plan submitted is not signed or approved by the competent Authority i.e. Govt. Engineer.
• The land area is less than 3000 sq. mtrs.
• The institution was granted recognition for B.Ed. Course with an intake of 100, the land required for proposed D.El.Ed. Course is 3000 sq. mtrs. as per NCTE Regulations 2009.

In view of the reply of the Show Cause Notice dated 1.2.2012 and the above observations, the Committee decided to issue show cause notice to the institution as to why the permission of the institution for D.El.Ed.  Course be not refused on the above points. The Committee therefore, provides an opportunity under section 15(3)(b) of the NCTE Act 1993 to the institution to submit its reply  within 21 days before the Committee takes final decision.

133.10.7

• The name of the applicant society is Swamy Ram Krishna Paramahans Educational and Welfare Society.

In view of the above points it is clear that the land is not in the name of society or in the name of the proposed institution. The Committee decided to issue show cause notice to the institution as to why the Recognition of the institution for B.Ed Course be not refused on the above points. The Committee therefore, provides an opportunity under section 14(3)(b) of the NCTE Act 1993 to the institution to submit its reply  within 21 days before the Committee takes final decision.

•   The land is on lease basis from the State of West Bengal for and on behalf of Sriniketan Shantiniketan Development Authority of the Urban Development (T & CP).
•   As per the lease deed, it is seen that the Techno India has applied for setting up for development of techno Model School (Basic Education) and Business School and the lease deed have been executed for the purpose of the school. Moreover, from the document submitted, it seems that the lease deed is unregistered.

• The institution has submitted DD of Rs.41,000/- bearing number 809365 dated 12.09.2011 i.e. after the last date for submission of online application.
• The land document submitted by the institution is in name of an individual.  Photocopy of this document has been submitted rather than certified copy.

The reply to the Notice has not clarified the deficiencies pointed in the Notice. The institution is still deficient on the above points. The Committee, therefore, decided that the application be summarily rejected under clause 7(1-A) of NCTE Regulations 2009.

•  The institution has applied for Additional course M.Ed u/s 15 of NCTE Act 1993. The Institution is required to have accreditation by NAAC with Grade B certificate. The institution has not submitted the NAAC accreditations so far.
•   The institution has not replied to the Notice dated 30.06.2011 till date.

The Committee, therefore, decided to issue Show Cause Notice to the institution as to why the permission of the institution be not refused for additional M.Ed course on the above points. The Committee therefore, provides an opportunity under section 15(3)(b) of the NCTE Act 1993 to the institution to submit its reply  within 21 days before the Committee takes final decision.

133.10.18

Santipur Primary Teachers Training Institute, Plot No. 1298 & 1301, Vill- Babla Dakshinpara, Po- Babla gobindapur, Tehsil/Taluka- 9, Santipur, City- Santipur, Dist- Nadia, West Bengal – 741404 (D.El.Ed) (Private) (West Bengal Board of Primary Education) (Code No. ERCAPP741)

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs., and the reply of the deficiency letter the Committee observed that institution has also applied for D.El.Ed course vide application No: ERCAPP1136.

As per NCTE Regulations 2009 an institution would be considered for recognition of one basic unit of one programme. Therefore, both the applications vide ERCAPP1136 and ERCAPP741 for the same course by the same institution cannot be processed simultaneously.

In view of this the Committee decided that institution be asked to select either one of the two applications to be processed onwards. The institution will submit its choice within 15 days of the issue of letter. If the reply is not received within stipulated time the Committee would free to process appropriate application.

133.10.13

NCTE Hqrs.vide letter dated 26.3.2012 has forwarded application submitted by the Registrar, Manipur University for 4 year B.P.Ed. (ODL) Course. As the 4 year integrated course falls under the category of innovative programmes. The Committee decided to forward the proposal to NCTE Hqrs for the examination by the Standing Committee for Innovative Proposals at NCTE Hqrs.
